Chairman of the Teaching Staff Association Dr. Ibrahim Al-Hamoud called on the Minister of Health, Minister of Interior and Minister of Higher Education to intervene in enabling the teaching staff who are stranded abroad to enter the country and resume work at Kuwait University.
In a press statement, Dr. Al-Hamoud revealed that those stranded abroad due to force majeure are on paid leave as per the provisions governing the force majeure theory on one hand, and the provisions of the university law No. 76/2019 and the civil service law No. 15/1979, and the civil service system on the other hand.
He explained that the stranded teachers cannot be blamed as they are unable to enter Kuwait and carry out their duties at the university, reports Al-Rai daily. Their absence is not of their choice but rather due to circumstances that are out of their hands, such as the closure of the airports, which is considered as part of the measures for curbing the spread of COVID-19.
Dr. Al-Hamoud said, “It is known legally that the establishment of force majeure will result in interruption of duties, as it is impossible to do otherwise. Force majeure is known as foreign and unforeseen situation that cannot be avoided. It is out of the hands of those affected, and can result in inability to execute duties.”
