Ministry regulates car repair – Registers and warranties

The Minister of Commerce and Industry and Minister of State for Services Affairs Khalid Al-Roudhan has issued a decision on the rules and regulations concerning car spare parts to regulate the fixing and mechanical and electrical works, reports Al- Rai daily.

It is noteworthy to mention the Al-Rai daily in its Oct 20, 2019, issue had highlighted the issue obliging garages to give guarantee of up to a month on used spare parts and car repair.

The decision specifies a warranty period that varies between maintenance, repair and fixing of new spare parts, as well as painting from 30 to 180 days with special laws, regulations or other standards agreed upon by the parties on a longer term.

The decision, a copy of which has been obtained by the daily, talks about the following articles which should be taken into consideration.

Article (3): The warranty period for overhauling engine shall not be less than 90 days and not be less than 30 days for used one starting from the date of repair indicated in the repair shop invoice.

Article (4): The warranty period (overhaul) of the gear shall not be less than 90 days, and not less than 30 for replacement with used one from the date of installation as indicated in the repair shop invoice, except for race cars, the warranty period shall not be less than 30 days starting from the date of installation as indicated in the repair shop invoice.

Article (5): The warranty period for the new hydraulic installation shall not be less than 60 days, the repaired and refurbished hydraulics shall not be less than 30 days and the hydraulic used shall not be less than 15 days.

Article (6): The duration of the warranty for the installation of the air conditioning compressor of the vehicle, or charging gas in the unit shall not be less than 60 days starting from the date of work done as indicated in the repair shop invoice.

Article (7): The warranty period for the installation of the new front and rear body shall not be less than 30 days and for second hand material 15 days starting from the date of maintenance, repair or installation as stated in the repair shop invoice.

Article (8): The warranty period for the installation of new electrical works of all kinds, including lights, dynamo, and switch shall not be less than 30 days and for used parts 15 days starting from the date of maintenance, repair or installation indicated in the repair shop invoice.

Article (9): The warranty period for the installation of the new computer shall not be less than 30 days and if second hand not less than 15 days starting from the date of maintenance, repair or installation stated in the repair shop invoice.

Article (10): The warranty period of the vehicle paint shall not be less than 180 days starting from the date of maintenance or repair indicated in the repair shop invoice.

Article (11): Spare parts used for disc brakes may not be sold or installed.

Article (12): After the inspection of the vehicle, the repair workshop shall determine the work required to repair it, its completion date and cost. The vehicle owner has the right to accept or refuse maintenance, repair or installation.

Article (13): The repair shop is obliged to keep a register that includes all maintenance, repair or installation works that it performs on the vehicle. It shall also open a file for each vehicle separately with a statement of the cash received and shall deliver a copy to the customer in this regard.

Article (14): The consumer may inspect the old spare part if he does not pay for the piece he has replaced (the new), and must deliver the old piece if paid for the new piece, if the old piece is harmful to the environment, the repair shop must dispose it of safely in accordance with the regulations and decisions of the Environment Public Authority.

Article (15): The consumer may request to change the part that has been installed in the vehicle when it is proved that it does not work during the specified periods according to the report of the technical inspection department at the Traffic Department or its approved garages.

Article (16): The warranty for maintenance, repair or installation shall be forfeited if it is found that the defect or malfunction was due to the misuse, negligence of the consumer, or due to accidents or sabotage, when this is proved upon the report of the technical inspection at the General Traffic Department, otherwise the guarantee of maintenance, repair or installation shall be considered valid.

Article (17): If the licensee undertakes to supply the used or repaired part, he shall be responsible for its quality and shall guarantee it to the customer according to the periods specified in the attached table. In case of technical inadequacy of the workshop, the licensee shall be responsible for refunding the value to the customer or supplying another piece at the expense of the workshop.

Article (18): Every person licensed to the workshop should fix the table attached to this decision in a visible place and make it accessible to the public.
